MARKET PRICES ARE VOLATILE AND UNPREDICTABLE AND MAY BE AFFECTED BY A VARIETY OF FACTORS INCLUDING, AMONG OTHERS, GENERAL ECONOMIC CONDITIONS, POLITICAL EVENTS, MONETARY POLICIES OF VARIOUS COUNTRIES, FLUCTUATIONS IN PRODUCTION AND DEMAND, STOCK-PILES, SPECULATIVE ACTIVITY AND THE DEGREE OF CONCERN PEOPLE HAVE ABOUT THESE MATTERS. IT IS IMPOSSIBLE TO FORECAST ACCURATELY HOW OR TO WHAT DEGREE THESE OR OTHER FACTORS WILL AFFECT PRICES.
ACQUIRING PRECIOUS METALS AND NUMISMATICS SHOULD ONLY BE MADE WITH DISCRETIONARY FUNDS AND NOT WITH MONIES NECESSARY TO COVER OR PRODUCE DAY-TO-DAY LIVING EXPENSES.
WHAT IS SUITABLE FOR ONE CUSTOMER WITH A GIVEN FINANCIAL MEANS MAY NOT BE SUITABLE FOR THE GOALS OR EMOTIONAL MAKEUP OF A SECOND CUSTOMER OF THE SAME MEANS. BEFORE CUSTOMER CHOOSES TO COLLECT, CUSTOMER MUST DETERMINE IN CUSTOMER'S OWN MIND CUSTOMER'S ABILITY TO UNDERSTAND THE ACQUIRING PRECIOUS METALS AND NUMISMATICS AND TO MEET ALL FINANCIAL COMMITMENTS TO BE MADE, PURSUANT TO THIS AGREEMENT. PERSONS WITH LIMITED COLLECTING EXPERIENCE OR LOW INCOMES OR ASSETS SHOULD BE PARTICULARLY SENSITIVE TO THE RISK AND REQUIREMENTS INVOLVED IN ACQUIRING PRECIOUS METALS AND NUMISMATICS.
You may make purchases, sell to, and order from U.S. COIN DEPOT only in accordance with these Terms and Conditions and accompanying policies and procedures. Upon placing an order to purchase or sell with U.S. COIN DEPOT, you have entered into a binding and legally enforceable agreement. Prices and availability are subject to change, without notice.
All acquisitions, including coins and bullion, involve some degree of risk and are affected by numerous economic factors, all of which are beyond the control of U.S. COIN DEPOT. You, and not U.S. COIN DEPOT, are responsible for such risk, including, without limitation, market volatility and inability to liquidate the products at an acceptable price, or at all. Consult your investment or financial adviser prior to purchasing/selling and fully assess whether you possess adequate savings and income prior to considering such acquisitions. You represent and warrant to U.S. COIN DEPOT that you have sufficient experience and knowledge to make informed financial decisions and that U.S. COIN DEPOT is not making any recommendation with respect to such purchases and/or such sales.
REQUIREMENTS FOR USE
Every customer must be at least eighteen (18) years of age in order to conduct business with U.S. COIN DEPOT. In addition, every customer must be the actual owner of any and all property sold or attempted to be sold to U.S. COIN DEPOT, and every customer must be acting on his or her own behalf and not as the agent or representative of another person. U.S. COIN DEPOT may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.
Any customer or prospective seller may request U.S. COIN DEPOT to provide a telephone or e-mail quote for his or her items after such items have arrived at U.S. COIN DEPOT processing facility. Verbal offers may, at the discretion of U.S. COIN DEPOT be recorded. Upon a verbal acceptance by the customer of the telephone or e-mail quote, payment will be issued by U.S. COIN DEPOT within twenty four (24) hours of such acceptance, and the fourteen (14) day customer satisfaction holding period will no longer be applicable to such transaction.
PROTECTION AGAINST LOSS
U.S. COIN DEPOT will cover against loss of the total contents properly shipped to U.S. COIN DEPOT in accordance with the instructions and procedures established by U.S. COIN DEPOT and subject to the terms and conditions published at U.S. COIN DEPOT.
U.S. COIN DEPOT reserves the right, in its sole discretion, to reject the delivery of any mail, envelope, package or other item which appears to be opened, damaged or tampered with in any way. The post office or shipping company will return any such mail, envelope, package or item to the customer. U.S. COIN DEPOT will have no liability to any customer for any such attempted delivery or return of any such items.
LIMITATION OF LIABILITY
This limitation of liability shall be binding on the customer/seller and any third party, including but not limited to, customer's/seller's, successors, insurance carriers and any other individual or entity asserting any right or claim relating to this transaction.
In no event shall U.S. COIN DEPOT be liable to any third party, including any insurance carrier. U.S. COIN DEPOT shall not be liable for any subrogation claim brought by customer's/seller's insurance carrier and, by submitting an item to U.S. COIN DEPOT, customer/seller expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.
U.S. COIN DEPOT liability is and shall be expressly and specifically limited to the LEAST of the following sums:
1. The liquidation value placed on the item by U.S. COIN DEPOT at the sole discretion of U.S. COIN DEPOT .
2. One third (1/3) of the appraised value of the item(s) according to an appraisal done by an independent accredited appraiser submitted by a customer/seller to U.S. COIN DEPOT, which appraisal was issued not more than 3 years prior to the shipment and not after shipment of the item(s) to U.S. COIN DEPOT.
3. The sum of $100.00. The customer/seller expressly acknowledges and agrees that U.S. COIN DEPOT liquidated value shall be conclusive and binding and further, that in no event shall U.S. COIN DEPOT Liability exceed $100.00.
U.S. COIN DEPOT shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above. By submitting the item, customer/seller explicitly accepts this limitation of liability.
AGREEMENT TO INDEMNIFY U.S. COIN DEPOT FOR USING THIS WEBSITE
By using U.S. COIN DEPOT you agree to hold harmless U.S. COIN DEPOT, its directors, officers, agents and employees, from and against any and all claims, costs, expenses, and damages (including attorney's fees) arising out of or related to your access to this website.
DISPUTES AND APPLICABLE LAW
U.S. COIN DEPOT SHALL NOT BE LIABLE TO ANY PERSON FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, CONSEQUENTIAL, COMPENSATORY, PUNITIVE, BUSINESS LOSS OR INTERRUPTION DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE MATERIALS AND INFORMATION IN THIS WEBSITE. THIS PROVISION APPLIES EVEN IF U.S. COIN DEPOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Any dispute arising out of or relating to your use of this website shall be conclusively resolved by arbitration in the state of New York under the commercial arbitration rules of the American Arbitration Association then existing, and any judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy.
